GENERAL TERMS AND CONDITIONS OF SALE
These General Terms and Conditions of Sale govern the sale of products made through the website of Oleificio San Marco S.a.S, with registered office in Via della tecnologia, 12/14 – 07041 Alghero (SS), Sardinia - Italy, Giovanni Battista Salaris.
1. Subject
These terms govern the sale of products marketed by the Seller through the website oleificiosanmarcoalghero.it to consumers pursuant to Legislative Decree 206/2005 (“Consumer Code”).
2. Products, prices and features
The products for sale are described in the relevant product sheets available on the Site.
Prices are stated in Euro and are VAT included, unless otherwise indicated.
The applicable price is the one shown on the Site at the time the order is submitted by the Customer.
The Seller reserves the right to change prices at any time; such changes will not apply to orders already confirmed.
Product images are for illustrative purposes only and may not perfectly represent the actual features.
The Customer is responsible for the choice of the ordered products.
3. Orders
Submitting an order by the Customer constitutes a contractual offer.
The sales contract is deemed concluded only upon order confirmation by the Seller, sent by email to the address provided by the Customer.
The Seller reserves the right to refuse or cancel an order in case of:
unavailability of the products;
incomplete or incorrect data provided by the Customer;
suspected fraudulent activity.
4. Product availability
In the event of unavailability, even temporary, of the ordered product, the Seller will promptly inform the Customer, who may choose whether to:
wait for the product to become available;
receive a full refund of the amount paid.
5. Payment methods
Payment is due at the time the order is submitted and is possible only through the methods indicated on the Site.
6. Shipping and delivery
Deliveries take place approximately within:
7 business days for Italy;
15 business days for European Union countries,
unless unforeseen events or force majeure.
Delivery times are indicative and not binding.
7. Failed delivery due to recipient’s absence
If the Customer is absent at the time of delivery, the courier will leave a notice and the Customer must follow the instructions provided for collection or redelivery.
8. Right of withdrawal
8.1 Statutory right of withdrawal
Pursuant to Articles 52 et seq. of Legislative Decree 206/2005, the consumer Customer has the right to withdraw from the contract within 14 (fourteen) calendar days from the date of receipt of the products, without having to provide any reason.
8.2 How to exercise it
The right of withdrawal may be exercised by any explicit statement, including by email, sent to:

8.3 Return of products
Products must be returned:
intact;
unused;
in the original packaging;
within 14 days from the withdrawal notice.
Return shipping costs are borne by the Customer, unless otherwise indicated.
8.4 Refund
The Seller will refund all payments received, including standard shipping costs, within 14 days of receiving the withdrawal notice.
The refund may be withheld until the returned products are received or proof of shipment is provided.
8.5 Exclusions from the right of withdrawal
The right of withdrawal does not apply in the following cases:
sealed products that have been opened after delivery.
customized or made-to-measure products;
goods which, by their nature, are not suitable to be returned for hygiene or safety reasons.
9. Liability
The Customer is responsible for proper storage of the products after delivery.
The Seller is not liable for damage resulting from improper use of the products.
10. Force majeure
The Seller shall not be liable for delays or non-performance due to force majeure events, such as strikes, service interruptions, technical failures, natural events, or regulatory restrictions.
11. Applicable law and competent court
The sales contract is governed by Italian law.
For any dispute, the court of the consumer’s place of residence or domicile shall have jurisdiction, if located in Italy.
12. Processing of personal data
The processing of personal data is governed by the Privacy Policy, available on the Site, drawn up pursuant to EU Regulation 2016/679 (GDPR).
